Privacy Policy

Effective 22 December 2025

Avokado Sagl (hereinafter “Avokado Sagl”, “we”, “us” or “our”) operates the website https://www.avokadosolutions.ch (the “Website”).

This Privacy Policy explains how we collect, use, and protect personal data when you visit our Website or contact us. We are committed to processing personal data in full compliance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR).

1. Data Controller

The controller responsible for processing your personal data is:

Avokado Sagl

2. Personal Data We Collect

We collect only minimal personal data, strictly limited to what is necessary:

a. Automatically collected technical data

When you visit the Website, our server logs the following for security, functionality, and troubleshooting:

  • IP address
  • Date and time of access
  • Browser type and version
  • Operating system
  • Referrer URL

This data is anonymised or deleted shortly after collection and is not linked to identifiable individuals.

b. Theme preference

We use localStorage on your device to store your preference for light or dark theme. This data remains exclusively on your device and is not transmitted to our servers.

c. Analytics data (Mixpanel)

We use Mixpanel, a third‑party analytics service, only after you give explicit consent through our cookie banner. Mixpanel helps us understand how visitors interact with the Website and improve its performance.

When enabled, Mixpanel may collect:

  • Usage data (pages viewed, clicks, session duration, custom events)
  • Device and browser information
  • Approximate geolocation derived from IP address
  • Pseudonymous identifiers

We do not send names, email addresses, or any direct personal identifiers to Mixpanel. We use EU data residency to keep data within the EU/EEA.

No analytics data is collected or sent before consent.

d. Contact form data

When you submit our contact form, we collect the information you voluntarily provide:

  • Name
  • Email address
  • Company name (optional)
  • Phone number (optional)
  • Message content

We process personal data only for the following purposes and legal bases:

  • Technical logs and theme preference: our legitimate interest in maintaining a secure, functional, and user‑friendly Website (Art. 31 para. 2 FADP; Art. 6(1)(f) GDPR where applicable).
  • Analytics via Mixpanel: your explicit consent (Art. 31 para. 1 FADP; Art. 6(1)(a) GDPR).
  • Responding to contact form inquiries: steps taken at your request prior to entering into a contract or our legitimate interest in communicating with you (Art. 31 para. 2 FADP; Art. 6(1)(b) or (f) GDPR where applicable).

We do not use your personal data for marketing, profiling, automated decision‑making, or any other unrelated purposes.

4. Cookies and Similar Technologies

  • Strictly necessary: localStorage for theme preference (no consent required).
  • Analytics: Mixpanel sets cookies and uses localStorage for identifiers, session persistence, and tracking functionality. These are only activated (i.e., events are sent) after you give consent via the cookie banner. Mixpanel initialises on page load but does not track or send data until opt‑in.

You may withdraw your consent at any time via the cookie preferences link in the footer or by clearing browser data. Withdrawal does not affect lawfulness of processing before withdrawal.

5. Recipients and International Transfers

Your personal data may be accessed by:

  • Authorised personnel within Avokado Sagl;
  • Mixpanel, Inc. (USA), acting as our processor under a Data Processing Agreement including Standard Contractual Clauses (SCCs). We use Mixpanel’s EU Data Residency Programme so data is processed and stored within the EU/EEA;
  • Hosting and technical service providers located in Switzerland or the EU/EEA, bound by strict data protection obligations.

We do not sell your data. Transfers outside Switzerland/EU/EEA (e.g., to Mixpanel US for support) are covered by appropriate safeguards (SCCs and Data Privacy Framework participation where applicable).

6. Data Retention

  • Technical logs: retained for a short period (typically a few months) for security purposes, then deleted or anonymised.
  • Analytics data: retained as configured in Mixpanel.
  • Contact form data: retained for up to 12 months after the last contact, or longer if required by law.

7. Your Rights

Under applicable data protection laws, you have the following rights regarding your personal data:

  • Right of access
  • Right to rectification
  • Right to erasure (“right to be forgotten”)
  • Right to restriction of processing
  • Right to object
  • Right to data portability (where applicable under GDPR)
  • Right to withdraw consent at any time (without affecting the lawfulness of processing prior to withdrawal)

To exercise these rights, please contact us using the details in Section 1. We will respond without undue delay and free of charge (unless requests are manifestly unfounded or excessive).

You also have the right to lodge a complaint with the Swiss Federal Data Protection and Information Commissioner (FDPIC) or, if GDPR applies, with your local supervisory authority.

8. Data Security

We implement appropriate technical and organisational measures, including encryption in transit, access controls, and secure hosting, to protect your personal data against unauthorised access, loss, destruction, or alteration.

9. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The updated version will be published on the Website with a new “Last updated” date. We encourage you to review this page periodically.
